24/7 Emergency Response Requirement

When notified by the District Representative, Service Provider shall acknowledge urgent calls within fifteen (15) minutes and shall provide services onsite within two (2) hours, 24 hours, seven (7) days a week, including holidays (Exhibit C – Holidays). Service Provider shall have an answering service, cell phone, or office personnel available at all times to receive urgent requests.

Prevailing Wage / Davis-Bacon

In accordance with the provisions of Labor Code section 1773, the District has ascertained from the Department of Industrial Relations the general prevailing rate of per diem wages (which rates include employer payments for health and welfare, vacation, pension and similar purposes) and the general prevailing rate for holiday and overtime work in the locality in which the work is to be performed under this Agreement for each craft, classification or type of worker needed to perform the Agreement. Bidder and each Sub Contractor shall pay not less than the specified prevailing rates of wages to all workers employed in the execution of this Contract.
Public Works Contractor Registration Requirement

No contractor or subcontractor may be listed on a bid proposal for a public works project (submitted on or after March 1, 2015) unless registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5. No contractor or subcontractor may be awarded a contract for public work on a public works project (awarded on or after April 1, 2015) unless registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5. The Bidder and its Subcontractors, upon failure to comply with Section VII above may be deemed non-responsive and bid may be rejected.
Taking Exceptions / Altering RFP Terms Can Void the Bid

If a Bidder desires to take exception to the Service Agreements, Bidder shall provide the following information in a letter identified as 'Exceptions to the Service.' At the discretion of the District, exceptions not called out in the letter submitted will not be negotiable after the due date for submission of bid. Bids that take exceptions to the Service Agreement or proposed compensation terms may be determined by District, at its sole discretion, to be unacceptable and no longer considered for award.
